Terms of Service

Hermes Agent instances operated by Ted Hwang  ·  Effective date: 23 October 2026  ·  Last updated: 23 October 2026

1. Acceptance of these terms

These Terms of Service ("Terms") govern the use of the Hermes Agent instances described in Section 2 (each an "Instance"). By using an Instance, a user accepts these Terms.

2. Instances covered by these terms

These Terms apply to all Hermes Agent instances operated by Ted Hwang, comprising a personal instance used only by the operator, and team instances used by small teams led by the operator. Each Instance is a deployment of the open-source Hermes Agent software running on a device controlled by the operator.

3. Authorized users and accounts

Use of an Instance is limited to the operator and, for team Instances, the members the operator has authorized. Each authorized user connects only their own accounts, and is responsible for the accuracy and legality of the actions they instruct the Instance to perform. A user must not use an Instance to access data belonging to another person without that person's authorization.

4. Permitted use

An Instance is intended for the personal and internal work purposes of its authorized users. Users are responsible for complying with the terms of any third-party service an Instance accesses, including the Google APIs Terms of Service, and with any policies of their organization.

5. No warranty

An Instance is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose and non-infringement. Automated actions may be incorrect or incomplete, and users should verify results before relying on them.

6. Limitation of liability

To the maximum extent permitted by law, the operator is not liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, an Instance.

7. Third-party services

The Instances integrate with third-party services, including Google APIs and the large language model provider configured for each Instance. Those services are governed by their own terms, and the operator is not responsible for them.

8. Suspension and removal of access

The operator may suspend or remove a user's access to an Instance at any time, including on a member's leaving the team the Instance serves. Users may stop using an Instance, and revoke connected accounts, at any time.

9. Changes to these terms

These Terms may be updated from time to time. Any changes will be posted on this page together with a revised effective date.
